Terms and Conditions
Effective Date: August 4, 2026
These Terms and Conditions govern your use of pinnacleathleticclub.com (the “Website”) and your registration for programs, services, events, teams, camps, clinics, tryouts, and other activities offered under the Pinnacle Athletic Club brand, including programs operated through Volitude Volleyball (collectively, “Pinnacle,” “we,” “us,” or “our”).
By accessing the Website, making a purchase, or registering yourself or a minor participant for a Pinnacle activity, you agree to these Terms. If you do not agree, please do not use the Website or complete a registration.
1. Parents, Guardians, and Minor Participants
Most Pinnacle programs are intended for youth athletes. A participant under 18 must be registered by a parent or legal guardian.
By registering a minor, you represent that:

  • You are the participant’s parent or legal guardian, or you have authority to complete the registration;

  • The information you provide is accurate and complete;

  • You have reviewed the program requirements with the participant; and

  • You agree to these Terms on your own behalf and, to the extent permitted by law, on behalf of the participant.

Children under 13 should not submit information directly through the Website. Their parent or guardian must complete registrations and inquiries for them.
2. Programs and Availability
Pinnacle offers volleyball teams, tryouts, clinics, camps, training programs, recruiting education, and related activities. Program descriptions, schedules, coaches, locations, prices, and availability may change.
Registration does not guarantee:

  • Selection for a club team;

  • A particular roster, coach, position, or level;

  • Playing time;

  • Continued participation;

  • Athletic improvement, recruiting exposure, a scholarship, or admission to a college; or

  • The attendance of a particular guest coach or college program.

Team selection and playing decisions are made by Pinnacle’s coaching staff based on program needs, attendance, conduct, development, and competitive considerations.
3. Registration Information
You agree to provide accurate, current, and complete registration information, including participant age, grade, contact information, emergency information, and relevant health or accommodation information.
You are responsible for updating Pinnacle if this information changes. Pinnacle may decline or cancel a registration if information is materially inaccurate, incomplete, or misleading.
Participation may require additional forms, including a medical authorization, emergency contact form, code of conduct, media release, or assumption-of-risk and liability waiver. Those documents are separate from these Website Terms and will control if they conflict with these Terms on the same subject.
4. Prices and Payment
All prices are displayed in U.S. dollars unless stated otherwise. Payment is due at the time specified during registration or in the applicable team agreement.
You authorize Pinnacle and its payment processors to charge the payment method you provide for all applicable registration fees, tuition, deposits, installments, and approved charges.
You are responsible for any fees resulting from a declined payment, chargeback, or unpaid balance, to the extent permitted by law. Pinnacle may suspend participation or withhold services while an account remains past due.
Club-team tuition, installment schedules, travel costs, uniforms, tournament expenses, and other season-specific charges may be governed by a separate written agreement or fee schedule.
5. Booking, Cancellation, and Refund Policy
Unless a registration page or separate written agreement expressly states otherwise, bookings for clinics, camps, tryouts, and training sessions are final.
Pinnacle does not provide make-up sessions, credits, refunds, or rescheduling for:

  • Participant cancellations;

  • Missed sessions or no-shows;

  • Late arrivals;

  • Scheduling conflicts;

  • Changes in personal plans; or

  • Removal resulting from a participant’s violation of safety or conduct requirements.

Please confirm that the participant can attend before completing a booking. A space is reserved once registration and required payment are completed.
Different terms may apply to club-team tuition, deposits, or season commitments. Those terms will be stated in the applicable team agreement.
Nothing in this policy limits a refund or other remedy required by applicable law.
6. Changes or Cancellations by Pinnacle
Pinnacle may cancel, relocate, reschedule, combine, shorten, or otherwise adjust a program because of low enrollment, facility conflicts, coach availability, weather, unsafe conditions, public-health concerns, or other circumstances beyond Pinnacle’s reasonable control.
If Pinnacle cancels an activity, Pinnacle may provide an appropriate credit, transfer option, rescheduled session, or refund. The available remedy will depend on the circumstances and any applicable program agreement.
Pinnacle is not responsible for incidental expenses such as travel, lodging, meals, equipment, or lost work arising from a schedule change or cancellation.
7. Health, Safety, and Participation Risks
Volleyball and athletic training involve inherent risks, including falls, collisions, physical contact, overexertion, and other injuries. Participation is voluntary.
Participants must follow all safety instructions, facility rules, and coaching directions. Parents and guardians are responsible for determining whether a participant is physically able to participate and for informing Pinnacle of relevant injuries, medical conditions, allergies, medications, or necessary accommodations.
Participants should not attend while experiencing a contagious illness or when participation would be medically unsafe.
Pinnacle may require a participant to stop or modify participation when staff reasonably believe continued activity presents a safety concern. Emergency treatment authorization and any release of liability will be addressed in separate registration documents.
8. Participant and Spectator Conduct
Participants, parents, guardians, and spectators are expected to treat athletes, coaches, officials, staff members, opponents, and other families respectfully.
Prohibited behavior includes:

  • Harassment, bullying, threats, discrimination, or retaliation;

  • Violence, fighting, or intentionally unsafe conduct;

  • Abusive or disruptive communications;

  • Damage to facilities or equipment;

  • Possession or use of illegal drugs, alcohol, or weapons at youth activities; and

  • Conduct that materially interferes with a safe and productive program environment.

Pinnacle may issue a warning, restrict attendance, suspend participation, remove an individual from an activity, or terminate participation when reasonably necessary to protect participants or the club community.
9. Photos, Video, and Athlete Information
Pinnacle may photograph or record programs for coaching, safety, documentation, or promotional purposes when permitted by the applicable registration forms and media authorizations.
A parent or guardian may contact Pinnacle regarding media preferences. Pinnacle will make reasonable efforts to honor documented restrictions, subject to limitations involving public events, team photographs, third-party venues, or recordings outside Pinnacle’s control.
Pinnacle will not intentionally publish sensitive medical information or personal contact details as promotional content.
10. Communications
By providing contact information, you agree that Pinnacle may send administrative messages concerning registrations, schedules, payments, safety, and program operations.
Marketing emails will be sent according to the preferences you select. You may unsubscribe using the link in a marketing email. Unsubscribing from marketing does not prevent necessary administrative communications relating to an active registration.
11. Website Use
You may use the Website only for lawful, personal, and noncommercial purposes.
You may not:

  • Attempt to gain unauthorized access to the Website or another user’s information;

  • Introduce malicious code or interfere with Website operation;

  • Scrape, reproduce, or commercially exploit Website content without permission;

  • Impersonate another person;

  • Submit false or fraudulent information; or

  • Use the Website in a manner that violates applicable law.

12. Intellectual Property
The Pinnacle name, logos, photographs, graphics, videos, text, program materials, and Website design are owned by or licensed to Pinnacle and are protected by applicable intellectual-property laws.
You may not reproduce, modify, distribute, sell, or publicly use this content without Pinnacle’s prior written permission, except for personal, noncommercial use relating to participation in Pinnacle programs.
13. Third-Party Services and Links
The Website may use or link to third-party services, including payment processors, scheduling platforms, facilities, tournament organizers, social-media platforms, and recruiting resources.
Pinnacle does not control third-party websites or their privacy and security practices. Your use of a third-party service may be governed by that provider’s separate terms and policies.
14. Disclaimers
The Website and its content are provided on an “as available” basis. Pinnacle makes reasonable efforts to keep information accurate but does not guarantee that all content will always be complete, current, or error-free.
To the fullest extent permitted by law, Pinnacle disclaims implied warranties relating to the Website and its content. Pinnacle does not provide medical, legal, academic-admissions, or professional recruiting advice through the Website.
Nothing in these Terms excludes a warranty or responsibility that cannot legally be excluded.
15. Limitation of Liability
To the fullest extent permitted by law, Pinnacle and its owners, affiliates, directors, coaches, employees, contractors, and volunteers will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from Website use.
Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, or any other liability that cannot be limited under applicable law.
Activity-related risks, releases, and liability limitations may also be addressed in a separate participant agreement or waiver.
16. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold Pinnacle harmless from third-party claims, losses, or expenses arising from your unlawful use of the Website, violation of these Terms, fraudulent registration information, or infringement of another person’s rights.
This section does not require a parent or participant to indemnify Pinnacle for Pinnacle’s own gross negligence, willful misconduct, or other conduct for which indemnification is prohibited by law.
17. Changes to These Terms
Pinnacle may update these Terms periodically. The updated version will be posted with a revised effective date.
Changes will apply prospectively. Material changes affecting an existing paid registration will not replace contrary terms in a signed program agreement unless permitted by that agreement or accepted by the registering party.
18. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Before filing a legal claim, the parties are encouraged to contact one another and attempt in good faith to resolve the issue informally. Unless applicable law requires otherwise, disputes relating to these Terms will be handled in the state or federal courts serving the county where Pinnacle’s principal California place of business is located.
19. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
These Terms, together with the Privacy Policy, applicable registration terms, and any separately signed program agreement, form the agreement governing Website use and the applicable Pinnacle service.
